The introduction by the US administration of the 50% rule in the control of exports of dual-use goods is a cluster bomb with significant consequences for French and European exporters subject to this extraterritorial regulation. The new rule imposes drastic restrictions not only on exports to end users mentioned on the ‘entity list’, but also to all companies owned 50% or more by listed entities. The number of end users subject to restrictive measures is therefore skyrocketing, making due diligence operations extremely complex, uncertain and risky for exporters.
